Determining the period of employment

1. For calculating pensions, the followings are calculated by adding to seniority:

a) Regardless of type of work, the type of activity, property and types of business, any task carried out by the employee under the state social insurance is calculated by adding seniority, if there are any of the insurance benefits paid to the Off-budget Pension Fund under the Ministry of Finance of the Republic of Uzbekistan.

Seniority of creative employees, if they have paid insurance premiums to the off-budget Pension Fund under the Ministry of Finance of the Republic of Uzbekistan, the managements of creative unions shall determine seniority from the author's work  from the date of the first public performance.

 b) Being in military service and guerrilla battalions and affiliates, serving in public security and internal affairs agencies;

 c) Service in the armed forces, special communications and mining and rescue units irrespective of their subordination;

g) Individual labor activity, including individually (group) rent or personal subsidiary, peasant (farmer) economy - in case of payment of insurance premiums to the Off-budget Pension Fund under the Ministry of Finance of the Republic of Uzbekistan;

d) time dependent on a  person  with disability (group I) or disabled child under the age of 16, as well as elderly people ( need  of others' care) aged 80 years old, (according to the conclusion of the medical institution)

e) full-time study in higher education institutions, post-graduate courses, doctoral studies and clinical internships, including study abroad;

j) the time of childcare till the age of 3 years, but not more than 3 years;

h) the period of residence of wives of officers, ensigns, midshipmen and servicemen of extended service with their husbands in areas where there is no possibility of their employment, but no more than 10 years.

The periods provided for in clauses "d" and "i" of this article shall be included in the seniority provided that there is at least 7 years of total seniority specified in points "a" - "g" of this article.

For persons who become disabled, the periods stipulated in points "e" - "z" are counted in the seniority, regardless of the seniority specified in points "a" - "g" of this article.

The period of disability of Groups I and II due to a labor injury or occupational disease is included in the seniority during the appointment of a pension for the age and for the loss of the breadwinner.

The period of seniority after appointment of age related pension is not included in seniority for the calculation of pensions.

 In the event that the periods indicated in points "a" - "z" are at the same time for the same period, only one period is included in the seniority for calculating the pension, at the request of the pensioner applying for the appointment.


2. The followings are calculated in seniority preferentially:

a) in military units and organizations of the armed forces, the work of guerrilla troops and allies in the war-time period, participation in military  operations in the performance of an duty -  in triple size;

b) during the Great Patriotic War (from June 22, 1941 to May 9, 1945) internal work in the country, including the work of the freely recruited military personnel and the service provided for in part "a" of this article  - in double size

c) each full year of work entitling them to a pension on preferential terms in accordance with Article 10 (a) and (b) and Article 11 (a) of the Law of the Republic of Uzbekistan "On the provisions of State Pensions for Citizens", for over 10 years for men and 7 years 6 months for women - in a double size;

d) work in leprosaria, anti-plague establishments, in infectious institutions for the treatment of persons infected with the human immunodeficiency virus - in a double size;

e) the work of certain categories of medical workers of pathoanatomical institutions and institutions of forensic medical examination specified in Appendix №  3 to the Regulations "on the Procedure for the Appointment and Payment of State Pensions", approved by Resolution № 252 of the Cabinet of Ministers, from September 8, 2011, - one and a half times;

f)when citizens are unfairly prosecuted, unreasonably repressed and subsequently rehabilitated,  the time spent in custody and stay in places of detention of citizens- one and a half times the size.


The procedure for preferential calculation of the seniority provided for in this paragraph applies to all types of pensions appointed by the Law.

When determining the right to a retirement, the seniority that gives the right to retirement is determined by the guidelines set out in subparagraphs (a) to (e).

The procedure for calculating the length of seniority for the purpose of assigning pensions to flight and flight test personnel is specified in Appendix № 4 to the Regulations "on the Procedure for the Appointment and Payment of State Pensions", approved by Resolution № 252 of the Cabinet of Ministers of September 8, 2011.

3. in the seniority of  a member of a farm, a person engaged in the breeding of cattle and selling livestock products produced in personal subsidiary and peasant farms and also a state farm worker, one calendar year is counted if he\she paid insurance contributions to the  off-budget Pension Fund in a given year for less than 9 months.

4. The main document confirming the seniority is the work book. In the absence of a work record book, as well as in cases where there are no necessary records in the workbook or incorrect and inaccurate records of periods of work activity,  in order to prove the seniority (except for the seniority of the employed person), certificates, extracts from orders, personal accounts and payroll records, employment contracts (contracts), archival references and other documents containing information on periods of employment are received.

In this case, the certificate should include information on employment, on the movement of the work (position) and on the termination of the employment contract, indicating the grounds. The certificate is signed by the head of the organization or archive, as well as by the employee who prepared the certificate, and is certified by the main stamp of the organization or archive that issued the certificate.

The seniority is established according to documents issued from the place of work, service, study or other activities, counted in the seniority, as well as archival institutions.

In cases when the documents on the seniority have not been preserved in whole or in part as a result of military operations, natural disasters, accidents, disasters or other emergencies, the confirmation of the seniority is carried out by the special commissions for establishing the seniority, created by the Cabinet of Ministers of the Republic of Uzbekistan, the Council of Ministers of the Republic of Karakalpakistan or local government bodies of regions, districts (cities).

The periods of employment established by these commissions on the basis of partially preserved documents and testimonies of witnesses are included in the seniority, as well as in the special seniority giving the right to a preferential pension, as the work time confirmed by the documents.

In the purpose of determining the validity and reliability of the documents presented on the seniority , the Pension Fund Department:

assesses the content and proper registration of the documents submitted for approval of the seniority, and, if necessary, makes a decision to verify the validity of their assignment;

in necessary cases, shall decide whether to deduct or exclude from calculating the seniority of certain periods of employment.
