Determination of earnings for calculating pension
Earnings for the calculation of pensions are taken for any consecutive five years in a row (based on the choice of the plaintiff) during the last ten years of employment, regardless of any interruptions in work.
Earnings for the calculation of pensions are recalculated to bring the earnings of past years to the level of earnings on the day of granting the pension in the manner prescribed by the Regulation "on the procedure for counting the earnings taken for the calculation of pensions, with the use of individual earnings ratios" approved by the Cabinet of Ministers on September 8, 2011. No. 252.
The average monthly earnings for calculation of a pension is determined by dividing the total amount of recalculated earnings for consecutive sixty calendar months of consecutive work by sixty.
In cases when applying for a disability pension or on the occasion of a loss of a bread-winner, the person who applied for a pension worked less than five years, the average monthly earnings for calculating a pension is determined by dividing the total amount of recalculated earnings for the calendar months of work by the number of these months.
When assigning pensions to seasonal workers, the average monthly earnings for calculating a pension is determined by dividing the total recalculated earnings for any five consecutive seasons by sixty of the last ten years.
To calculate the pension, the average monthly earnings in the amount not exceeding eight times the minimum wage are taken.
in the event that the average monthly earnings for calculating pensions are lower than the minimum wage or the data on earnings are completely absent, the pension is calculated on the basis of the minimum monthly wage.
Wages are taken from the calculated amount of wage.
Determination of wages based on testimony of witnesses is not allowed. Employee salaries, staffing charts, and community membership cards can’t be replaced by a document confirming actual wages. In the absence of archive data on earnings, the determination of the amount of earnings is made on the basis of information on mandatory contributions to the accumulative pension system for the period after 2005, as well as information from the Electronic Centralized Register of Individual Accounting of Accrued Insurance Contributions of Citizens to the Off-budget Pension Fund under the Ministry of Finance of the Republic of Uzbekistan for the period after 2015.
when information on earnings is partially absent, the minimum wage established by the legislation for the relevant periods is taken to determine wages for absent periods, without taking into account the regional coefficient.
In case of unreliable information contained in documents issued for the purpose of appointing a pension, or when corrections are found that distort information about wages, the department of the Pension Fund must check them prior to the appointment of a pension or send a written request for additional information or explanations to the issued certificates of earnings.
Periods not included in the seniority in connection with the failure to provide a certificate of earnings or the impossibility of verifying their reliability and validity, as well as periods of stay on leave without pay, are not excluded from the calculation of earnings for the last ten-year period of employment.
In the composition of earnings, all incomes (for which insurance premiums are assessed) in the form of wages specified in Article 172 of the Tax Code of the Republic of Uzbekistan, are included.
The amount of earnings of an employed person is determined on the basis of the amount of paid insurance contributions to theOff-budget Pension Fund under the Ministry of Finance of the Republic of Uzbekistan.
